Wills and
Trusts -- Estate Planning
What is Estate
Planning?
Estate planning is the process of arranging the transfer or
distribution of property and assets in the event of death or
incapacitation.
What is an
estate? What does it include?
An estate is all property (real or personal, tangible or
intangible) owned by an individual before distributing it through a will or
trust.
Living will laws cover various aspects of power of attorney,
health care decisions, and other related occurrences. A living will is usually
drafted with the help of an attorney specializing in wills and trusts.
The living will conveys information to doctors, family, and
others for when the author, or declarant, is unable to make decisions. This may
include directions to end medical treatment at a predetermined threshold. The
living will only goes into effect when the declarant is determined by a medical
doctor to have a terminal illness or permanent unconsciousness.
